GENERAL TERMS AND CONDITIONS OF BUSINESS

GENERAL PROVISIONS

Article 1

1.1. These General Terms and Conditions for the provision of parking services (hereinafter referred to as: General Terms) regulate the conditions for providing and using parking services at the parking lots operated by the parking provider, the mutual rights and obligations of the service provider and the user, as well as the methods of measurement, calculation, and payment of the provided service.

1.2. The company GOLUBICA PARKING d.o.o., Krapanjska 12, Zagreb, MBS: 080828665, OIB: 20459614645 (hereinafter referred to as: the parking operator) is the provider of the parking service at its parking lots located on designated public surfaces.

1.3. The parking operator provides parking services at four separate parking lots: “Parking Branimirova”, “Parking Cibona”, “Parking Radnička”, and “Parking Zavrtnica”.

CONDITIONS FOR PROVIDING AND USING THE PARKING SERVICE

Article 2

2.1. The parking operator provides the parking service in accordance with the legal and sublegal regulations governing traffic and public order, the principles of communal economy, and the regulations and other acts of the City of Zagreb relating to parking in the area of the City of Zagreb.

Article 3

3.1. By entering the parking lot, the user accepts these General Terms which define the organization and the method of parking fee payment.

3.2. By parking a vehicle in a public parking area, the user concludes a contract with the parking operator for the use of the public parking surface.

3.3. A public parking surface is an area designated for parking vehicles and organized as an outdoor, separately designated parking lot.

3.4. A user of the parking surface (hereinafter referred to as: user) is a driver who parks a vehicle in a parking space, or the vehicle owner registered in the appropriate records of the ministry responsible for internal affairs based on the vehicle registration number, or in other relevant official records.

3.5. A user is also considered to be the lessee to whom the vehicle has been given for use based on a leasing agreement, or a renter to whom a rent-a-car service provider has given the vehicle for use under a rental agreement.

3.6. The contract referred to in paragraph 2 of this Article excludes the custody of vehicles and liability for theft, destruction, or damage to the vehicle, unless otherwise provided by law.

MUTUAL RIGHTS AND OBLIGATIONS OF THE SERVICE PROVIDER AND USER

Article 4

4.1. It is prohibited to park vehicles in a manner that obstructs other users of the parking lot, blocks entrances or exits, or poses an obstacle within the parking area.

4.2. The user parks the vehicle in the parking lot at their own risk.

4.3. A user whose vehicle is stationary in the parking area is obliged to turn off the vehicle’s engine.

Article 5

5.1. Smoking and the use or disposal of flammable materials or other generally hazardous substances are prohibited in the parking area, as is the disposal of waste except in designated areas.

5.2. Any activities within the parking area without the consent of the parking operator are prohibited, as well as all activities contrary to applicable laws of the Republic of Croatia.

5.3. Users who act contrary to the provisions of these General Terms may be prohibited by the parking operator from further use of the parking lot.

LIABILITY OF THE PARKING OPERATOR

Article 6

6.1. The parking operator is not liable for vehicle theft, any loss, or damage to vehicles or property located inside the vehicles of parking users (e.g., scratches on users’ vehicles, broken windows, any kind of vehicle damage, theft of items from vehicles, etc.).

6.2. The parking operator is not liable for any property or non-property damage caused by third parties that may occur to users’ or third-party property, or to users or third parties personally in the form of non-property damage, regardless of whether such liability is based on civil or criminal liability of the third parties.

OCCURRENCE OF DAMAGE TO VEHICLES OR PROPERTY WITHIN THE PARKING AREA

Article 7

7.1. In case of damage to a vehicle or any part of the property or equipment in the parking area, the user is obliged to report the damage immediately to the parking operator.

7.2. In case of damage to any part of the property or equipment of the parking lot, the parking operator may claim compensation for damages from the person who caused the damage.

SECURING VEHICLES AND PROPERTY

Article 8

8.1. Before leaving the vehicle in a parking space, the user is obliged to check that the vehicle is locked, all windows and sunroofs are closed, and the parking brake is engaged.

8.2. When leaving a parked vehicle, personal belongings and valuables should be taken with the user, and other items/property in the vehicle should be stored safely and out of sight of other users or individuals in the area.

8.3. Users leave items in their vehicle at their own risk, and the parking operator is not responsible for their disappearance.

METHOD OF MEASURING, CALCULATING, AND PAYING FOR THE SERVICE

Article 9

9.1. The parking fee is charged to all users throughout the calendar year, from 00:00 to 24:00.

9.2. The parking fee is displayed in the price list located at the entrance to the parking lot, on the notice board, and on the official website of the parking operator.

9.3. Types of parking tickets include: hourly, daily, and monthly.

9.4. A daily parking ticket is valid from the time of issue until the same time the following day (24 hours).

9.5. A monthly parking ticket is valid for 30 days from the moment of renewal. If the monthly ticket is renewed before its expiry, it is calculated from the time of expiry of the valid ticket, not from the date of payment.

9.6. After the expiration of the hourly, daily, or monthly ticket, the user shall pay the fee in accordance with the hourly parking rate provisions.

9.7. An hourly ticket for short-term users is issued for a specific parking lot upon entry and is valid until exit. It is calculated based on the total number of hours parked, with every started hour counted as a full hour. If uninterrupted parking exceeds 5 hours, a daily ticket is charged according to the valid price list.

9.8. Payment for hourly and daily parking is possible exclusively at automated payment machines, and exceptionally at the official office of the parking operator. Monthly tickets may be paid for at automated payment machines or through the company’s transaction account with the issuance of an R1 invoice.

9.9. Users are advised not to leave the parking ticket in the vehicle, damage it, or keep it near mobile or electronic devices or heat sources.

9.10. The user is obliged to pay for hourly parking service before leaving the parking lot. After payment, the user must immediately exit the parking lot.

9.11. If the user does not leave the parking lot within 10 minutes after payment, a new hour of parking is considered started and must be paid for.

9.12. Upon entering the parking lot, short-term users receive a parking card and are granted a grace period to exit. This applies to taxis and/or delivery vehicles:

9.13. Monthly users must check in and out of the parking lot using the same monthly card each time.

9.14. Monthly parking tickets for private individuals that are renewed at the automated payment machine must be renewed while the vehicle is inside the parking lot.

9.15. In the case of expiration of a monthly parking ticket, it is possible to enter the parking lot using the monthly card, and the user is granted 3 (three) free hours to renew the ticket at the automated payment machine. After the 3 free hours, a daily parking ticket will be charged.

Article 10

10.1. The parking operator reserves the right to limit the number of monthly parking tickets that users can purchase for specific parking lots.

Article 11

11.1. In case of loss of any type of parking ticket, the user is obliged to report the loss to the parking operator immediately upon becoming aware of it.

11.2. The price of a lost hourly parking ticket is 50 EUR. If the amount due for hourly parking exceeds 50 EUR, the user will pay the amount according to the actual time of use. Once paid, refunds are not possible.

Article 12

12.1. Parking lots are under video surveillance for the purpose of protecting people and property. Surveillance footage is stored for 14 days.

12.2. Access to the video surveillance system and footage is granted to authorized personnel and competent state authorities within the scope of their legally defined responsibilities.

12.3. By entering the parking lot, the user accepts the general terms of business and consents to the collection and processing of personal data, including being recorded along with their vehicle via the video surveillance system.

COMPLAINTS AND INFORMATION

Article 13

13.1. All information regarding the use of the parking lot is available on the official website of the parking operator: www.parking.hr and can also be requested at the address GOLUBICA PARKING d.o.o., Krapanjska 12, Zagreb, Monday to Friday from 8:00 to 17:00, or via email: info@parking.hr.

Article 14

14.1. In accordance with consumer protection regulations, users may submit written complaints in person at Krapanjska 12, Monday to Friday from 8:00 to 17:00, by mail to the same address, or via email to info@parking.hr and neven@parking.hr.

FINAL PROVISIONS

Article 15

15.1. For all matters not regulated by these General Terms, other applicable regulations shall apply.

15.2. These General Terms will be published on the official website of GOLUBICA PARKING d.o.o. www.parking.hr, will be available at every point of sale, and can be provided upon request. A shortened version of the General Terms is published on each notice board and information panel at the parking lot itself.

Article 16

16.1. These General Terms come into force on the date of adoption and remain valid indefinitely.
